Terms of Service

1. Acceptance of Terms

By creating an account, uploading content, or otherwise using ZARD (the “Service”), you (“User”, “you”) agree to be legally bound by these Terms of Service (the “Terms”) and by our Privacy Policy and Disclaimer, which are incorporated by reference. If you do not agree, do not use the Service. You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use ZARD.

2. No Affiliation with Card Publishers

ZARD is an independent digital vault, catalog, and social platform for collectors of trading cards. ZARD is not affiliated with, endorsed by, sponsored by, or otherwise associated with The Pokémon Company International, Nintendo, Creatures Inc., GAME FREAK inc., Wizards of the Coast, Konami, Upper Deck, Panini, Topps, or any other trading-card manufacturer, publisher, or rights holder. All trademarks, character names, artwork, set names, and card designs are the property of their respective owners. References to those marks on ZARD are for identification purposes only and constitute nominative fair use.

3. Physical-Ownership Requirement

You represent and warrant that every card you upload, catalog, list, display, or share on ZARD is a physical card that you personally, lawfully own at the time of upload. You further warrant that:

• The images you upload are your own original photographs of your own card, or images you have the right to use.
• You will not upload cards belonging to another person without their written permission.
• You will not upload counterfeit, reproduction, proxy, or fraudulently-graded cards and misrepresent them as authentic.
• You will remove or update a listing promptly if you sell, gift, lose, or otherwise no longer own the card.

Violations may result in immediate suspension or termination of your account and, where applicable, referral to law enforcement or rights holders.

4. AI Verification — No Guarantee of Authenticity or Value

ZARD uses automated computer-vision (“AI”) checks to help detect obvious anomalies and to name/classify uploaded cards. These checks are probabilistic and are not a substitute for professional grading or authentication by PSA, BGS, CGC, TAG, or any other authority. ZARD makes no representation or warranty as to the authenticity, condition, grade, rarity, or market value of any card displayed on the Service, and no information on the Service should be relied upon for purchase, sale, or insurance decisions.

5. User Content & License

You retain ownership of the photographs and text you upload (“User Content”). By uploading, you grant ZARD a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (e.g., resize, thumbnail, watermark, run AI classification on), publicly display, and distribute your User Content solely to operate, promote, and improve the Service. You can revoke this license by deleting the content, except to the extent it has already been shared with other users or is retained in backups.

6. Prohibited Conduct

You agree not to:

• Upload content you do not own or have permission to use;
• Impersonate any person or misrepresent your affiliation;
• Harass, threaten, dox, or send unwanted sexual content to other users through chat or any feature;
• Use the Service to commit fraud, launder money, or facilitate the sale of counterfeit goods;
• Scrape, reverse-engineer, or bulk-download other users’ vaults;
• Interfere with the Service’s security or integrity.

7. Messaging Between Users

Direct messages are visible only to the participants of the conversation and to ZARD staff when required to enforce these Terms or comply with law. You are solely responsible for the content you send. Do not share sensitive personal, financial, or payment information over chat.

8. Transactions Between Users

ZARD is a display and social platform. Any sale, trade, or transfer of a physical card arranged between users is strictly between those users. ZARD is not a party to those transactions, does not escrow funds, and makes no warranty regarding either party’s conduct. Proceed at your own risk.

9. Termination

We may suspend or terminate your account at any time, with or without notice, for any suspected violation of these Terms or where required by law. You may delete your account at any time from Profile settings.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZARD, ITS OPERATORS, AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CARDS (PHYSICAL OR DIGITAL), ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) US $50.

12. Indemnification

You agree to indemnify and hold harmless ZARD and its operators from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your User Content, your breach of these Terms, or your violation of any law or third-party right, including intellectual property rights of card publishers.

13. Intellectual-Property Complaints

If you believe content on ZARD infringes your intellectual-property rights, contact us at legal@zard.app with (a) a description of the work, (b) the URL of the alleged infringement, (c) your contact information, and (d) a good-faith statement under penalty of perjury. Repeat infringers will be terminated.

14. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced in the app. Continued use after the effective date constitutes acceptance.

15. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which ZARD’s operator is established, without regard to conflict-of-laws principles. Disputes shall be resolved exclusively in the state or federal courts of that jurisdiction, and you consent to personal jurisdiction there.
